A Johor Bahru security guard was sentenced to 21 years in prison and 24 strokes of the cane for 13 sexual offences against his six-year-old daughter.
JOHOR BAHRU: A 43-year-old security guard was sentenced to 21 years in prison and 24 strokes of the cane after pleading guilty to 13 counts of sexually assaulting his six-year-old daughter.
Sessions Court judges Madihah Zainol and Nor Aziati Jaafar handed down the sentences after examining the facts of the case presented by the prosecution.
The accused received 12 years’ jail and 14 strokes from Judge Madihah, and 21 years with 10 strokes from Judge Nor Aziati, with both sentences effective from his arrest date of February 18.
The courts ordered the prison terms for all 13 offences to run concurrently, resulting in a total of 21 years’ imprisonment and 24 strokes.
He was also ordered to undergo rehabilitation counselling during his imprisonment and remain under police supervision for two years after his release.
The offences occurred at a squatter house in Johor Bahru between January 22 and February 17.
The charges included four counts of physical sexual assault under the Sexual Offences Against Children Act 2017, which carries a maximum 20-year jail term.
He also faced four counts of non-physical sexual assault for committing a sexual act in front of the victim.
Two charges were for committing carnal intercourse against the order of nature under Section 377C of the Penal Code.
The accused was also charged with two counts of producing child sexual abuse material involving the victim.
A final charge was for rape under Section 376(3) of the Penal Code.
Deputy public prosecutors Manushri Stephen Suthakar and Nur Farah Wahida Shahudin prosecuted the case, while the accused was unrepresented.
During proceedings, the accused requested a reduced sentence, citing his need to care for six children and an unemployed wife with cancer.
Nur Farah Wahida requested a deterrent sentence proportionate to the offence’s seriousness and its long-term impact on the victim.
