
A club singer was acquitted of trafficking 400 grammes of cocaine after the prosecution failed to link her to the drugs found in a house.
KUALA LUMPUR: A High Court judge acquitted a 29-year-old club singer of a major drug trafficking charge today. Judge Noor Ruwena Mohd Nordin ruled the prosecution failed to establish a prima facie case against Emily Leo.
The judge found no clear evidence linking the accused to the drugs or proving she had control over them. “Thus, the court acquits and discharges the third accused (Emily), while the other three accused are ordered to enter their defence,” she said.
Emily had been jointly charged with three others for trafficking about 400 grammes of cocaine. The alleged offence took place at a residence in Brickfields on November 23, 2023.
The charge was framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952. This carries the death penalty or life imprisonment and whipping upon conviction.
Emily, who had been under remand since 2023, broke down in tears after the decision was delivered. She was represented by lawyers Sivahnanthan Ragava and Cyrus Tiu Foo Woei.
Deputy Public Prosecutor Mohamad Shahrizzat Amadan conducted the prosecution. The other three co-accused were ordered to enter their defence.
