
Two men denied charges of raping and sexually assaulting a teenage girl at a rented house in Puncak Alam earlier this month.
KLANG: Two friends pleaded not guilty in the Sessions Court here to charges of raping and sexually assaulting a 14-year-old girl.
Sales executive Muhammad Irfan Mohamad, 25, and public higher education institute student Ahmad Hamzi Alias, 25, entered their pleas after the charges were read separately before Judge Siti Aminah Ghazali.
Muhammad Irfan was charged with committing the act against the victim in a room at a rented house at 3pm on Feb 6.
Ahmad Hamzi was charged with committing the same act against the same victim at the same location at 5.30am on Feb 7.
Both accused, who are single, were charged under Section 376(1) of the Penal Code and Section 14(a) of the Sexual Offences Against Children Act 2017.
The charges carry a penalty of up to 20 years imprisonment and whipping upon conviction.
Deputy Public Prosecutor Nuruliannah Aimi requested that no bail be granted to the two accused.
She suggested a sum of RM20,000 with one surety for each accused if the court chose to allow bail.
“This includes additional conditions to report to the police station every month and not to harass the victim or prosecution witnesses,” she said.
Lawyer Mohd Safwan Saleh, representing Muhammad Irfan, appealed for lower bail as his client had only worked for a month with an income of RM2,400.
He said his client needed to support his family in Kelantan and would cooperate with court proceedings.
Lawyer M. Partiben, representing Ahmad Hamzi, requested lower bail as his client is a student undergoing practical training.
She stated he is still financially dependent on his family from the B40 income group.
Judge Siti Aminah allowed both accused to be granted bail of RM8,000 and RM7,000 respectively with one surety.
She imposed the additional conditions as requested by the prosecution.
The case was set for mention on April 9.
